PROPOSAL AND CONTRACT

...From this point on the person of persons in this contract shall be referred to as Contractor and Purchaser or Purchasers.

1. Dear Purchaser:

We propose to furnish all materials and perform all labor necessary to complete the following: _________ at $68.00 per square foot of living space. Any home over 1600 s.f. includes a 480 s.f. 2 car garage. Under 1600 s.f. a 1 car garage.

This home shall be built in compliance with all state and federal building codes applicable Per Plans. And shall carry a warranty in workmanship upon completion.

2. This home shall be built on an Allowance system. The purchaser shall have the freedom to select his own style on specific items with this system. Standard allowances are as follows.

(A) Cabinets and Counter Tops $1.80 per s.f. of living space. With installation.

(B) Floor Coverings $16.00 a square yard. With installation.

(C) Doors and Hardware $1.80 s.f. install no cost.

(D) Light fixtures,80¢ s.f. install no cost.

(E) Windows 10% of square footage of living space.

(example 2000 s.f. home 200 s.f. of windows, - a 3x5 window is 15 s.f.)

Note: All material not accounted for in allowance to be builders grade.

3. Home to be completed within 4 months from start of construction, providing their are no unknown delays with subcontractors, suppliers, weather, or financing. Starting date of construction to be within a reasonable time after approval of financing, and building permit.

4. Contractor to be responsible for arranging connection of Sewer, Septic, Water, Power, Gas, or other utilities. Purchaser to b responsible for costs.

(The above-mentioned costs may be applied to contract for financing purposes of dealt with separately.) The purchaser shall pay costs of power and water during construction and provide funding for well or hook up before ground break.

5. The contractor shall be responsible for home site pad preparation only.

6. Roads, Landscaping, Drainage, Engineering, and Tree removal, additional dirt to either house pad or property owned by purchaser, purchaser to provide and be financially responsible for funding of. This is an extra cost.

7. Purchaser to provide contractor with and Earnest Deposit in the amount totaling 2% of contract amount. This to be done to fray the costs involved prior to any construction start Earnest deposit to be fully refunded after completion of home or deducted from moneys owed.

8. All of the above work to be completed in a substantial and workman like manner according to standard practices. Mendez Construction to retain a valid New Mexico Contractors Lic. and Bonding as required for the sum of ________________$68.00 per sq. ft. of living space.

9. Payments to be made of reasonable draws as construction progresses.. Purchaser to provide permanent & Interim financing, as well as builders risk Insurance. Payment in full upon completion.

10. Any alterations or deviations fro the above specifications involved extra costs of material of labor will only become an additional charged over the sum mentioned in this contract. Again, any changes must be agreed upon by contractor and purchaser, and must be inscribed in an addendum.

11. In the event contractor deems necessary to file a mechanics lien to secure payment of the money due under its terms, purchaser, agrees to pay additional attorneys fees in a reasonable sum incurred by contractor for the above. A 1.5% late charge will be billed monthly for late payments.

NOTE

Purchaser to provide Builders Risk Insurance, and at time of completion of home, convert insurance to homeownerÕs policy.

DESCRIPTION OF MATERIALS

1. Footings to be put in existing elevation. Stem wall to be at least 6 in. above existing elevation. Or a monolithic pour. As to have the slab of house set above existing ground level.

2. Foundations Stems and slab 3000# p.s.i. . Concrete reinforced w/ 2- 1/ 2 in. grade 40 rebar in footing , 6x6 remesh in in the slab and perimeter insulation 3/4 in. x 24 in. rigid.

3. Vents - Heater flue size, 4 double wall in 7 in. single, Water Heater 3 in. double within 6' single, tank size 40 gallon.

4. Exterior wall 2x6 w/ headers: Wafer board on all corners w/ 1/ 2 in. black celotex. (subsiding)

5. Partition framing : Stud grade 2x4 16 oc.

6. Lintels of headers: wood 2-2x12 over 2x6 trimmers.

7. Doors sills. Concrete

8. Windows: Interior wrapped with sheet rock on all 4 sides.

9. Exterior finish: Jumbo tex with stucco wire fastened to studs per code. Standard 3 part stucco, with color coat, choice by purchaser.

10. Roof framing manufactured roof truss 1650 hemfir 4/12 pitch 24 o.c. Drop gable end roof system.

11. Roofing: 7/ 16 4x8 wafer board solid w/ clips, 15# felt underlay w/ 3 tab seal down roofing. Roof edge 1 1/2 galvanized metal 26 gauge, Color choice by Purchaser.

12. Interior wall finish: 1/ 2 sheet rock, tape and texture. Fire wall in garages: 5/ 8 sheet rock, tape only. All square corner bead.

13. Air infiltration package, heat loss and gain: (Caulking around rough openings, plumbing and electrical penetrations, Seal bottom plate with sill sealer for minimum heat loss or gain.)

14. Interior paint: Enamel for kitchen and baths. Flat for non water areas 2 coats each. Standard paint color shall be shell white, Contractors Grade, unless otherwise specified by purchaser.

15. Interior doors and trim: Prehung 1 3/8 door slab. Style to be selected by purchaser ñper allowance with all trim for both sides, install no charge.

16. Exterior doors 1 3/4 slab solid core or metal w/ foam core (Stanley recommended), per allowance with all trim for both sides, install no charge. Pre hung 6 9/16.

Garage door to include cost of installation per allowance.

17. Windows: Single hung (mfg. Alenco ) Double pace Aluminum . Window allowance to be 10% of the square footage of the living area. If over, an additional $200.00 per window is charged. Any tempered glass is an extra charge.

18. Purchaser to choose door style, for Cabinet and Counter Tops as well as color of stain per allowance. (to include installation)
19. Floor coverings: To be selected by purchaser ñper allowances, to include installation.

20, Plumbing: Double kitchen sink, stainless steel. Water closet or toilets white, contractors grade.

21. House drain p.v.c.. water piping copper.

22. Faucet - 2 handle, brass washerless. 1 kitchen and 2 bath faucets. Contractors grade.

23. Two complete bath units, fiberglass one piece.

24. Heating and Cooling Over head forced air flex insulated ducted, evaporated cooling to be mounted on roof. Heating and cooling to run thru the same ducting system. To be sized per structure.

25. Electric wiring Overhead 100 amps approximately 20 circuits. Any 220 wiring to be done at additional expense.

26. Light Fixtures: & bulbs Selected by Purchaser per allowance to include ceiling fans. Install no cost.

27. Wall Insulation R-19 Ceiling R-38.

28. Phone Jacks: Contractor to supply and install 3. ($20.00 ea. additional)

29 Skylights: Contractor to supply and install 2 - 2x4. Each additional $200.00

30. Contractor to supply and install Whole House Fan pitched roof only.

31. Contractor to supply and install doorbell contractors grade.

32. Garages are left unfinished, no insulation no sheetrock, with the exception of fire wall, which is the wall connection to the living space.

33. Purchaser is responsible for all Kitchen Appliances, to include Range with hood, Dishwasher Garbage disposal, Refrigerator, etc. In some cases the cost of appliances may be applied to contract for financing purposes.

34. No landscaping.

NOTE:

PURCHASER MAY OPT TO UPGRADE OR INCORPORATE EXTRAS, (WOOD STOVE, CATHEDRAL CEILINGS,, SOLARIUM WINDOWS, WALKWAYS ETC. ANY ADDITIONAL COST DUE TO UPGRADES IN MATERIALS OR EXTRAS MAY BE APPLIED TO CONTRACT FOR FINANCING PURPOSES OF DEALT WITH SEPARATELY. PURCHASER MAY IN SOME PHASES OF CONSTRUCTION, WISH TO DECREASE COSTS BY PROVIDING THEIR OWN MATERIALS OR LABOR.

Purchaser to provide 9 complete and approved sets of plans. Which will include heat calculations and site plans. We have a selection of plans available to our customers at no cost.

The undersigned acknowledges receipt of a true copy of this contract, acknowledges that he has read together with the contractor, and knows the contents thereof, and understands that no other agreement verbal or other wise, is binding upon the parties thereto, and that same contains the entire contract. (see page 2 of 8 #10.

We stand by the quality of our homes and to ensure the satisfaction of our customers, a 1 year warranty is provided on the construction of our homes effective immediately upon completion and or occupancy.

ACCEPTANCE:

You are hereby authorized too furnish all material and labor required to complete the work mentioned in the above contract for which the purchaser agrees to pay the amount mentioned in said contract, according to the terms thereof.

NOTE: Contractor solely reserves the right to renegotiate cost and terms of contract if construction hasnÕt begun within thirty days of signing of the contract.

NOTE: PURCHASER RESPONSIBLE FOR NEW MEXICO GROSS RECEIPTS TAX (APPROX. 6% OF THE TOTAL COST)

NOTE: SOME MUNICIPALITIES EMPLOY SPECIAL FEES, OTHER THAN BUILDING PERMIT FEES, SUCH AS IMPACT FEES OR ACCESS FEES PURCHASER IS TO BE RESPONSIBLE FOR SUCH FEES.
